Welcome to the website of the “Центр спадщини Вигодської вузькоколійки”. By using this website (the “Site”), you confirm that you have read and agree to these Terms of Use (the “Terms”). If you do not agree with any part of the Terms, please refrain from using the Site.

2) Access to the Site

• The Site is provided “as is” and “as available.” We strive for uninterrupted operation but do not guarantee error‑free performance, availability at all times, or compatibility with all devices/browsers.

• We may modify, update, limit, or temporarily suspend the Site without prior notice (e.g., for maintenance or security reasons).

3) Permitted use

You agree to use the Site lawfully, including to:

• browse Site pages, share links to them, and quote short excerpts with proper source attribution and a link to the Site;

• use materials for personal, educational, and non‑commercial purposes, unless expressly permitted otherwise by the rights holder.

Prohibited

You must not:

• violate applicable laws of Ukraine or the rights of third parties;

• copy, reproduce, publish, distribute, modify, or create derivative works from Site materials without prior written permission from the Museum or the respective rights holder (especially photos, videos, audio, illustrations, and logos);

• use automated means (scraping, bots, mass queries) that may affect the Site’s performance or security, except for standard search‑engine indexing that respects robots.txt;

• circumvent technical protection measures, interfere with servers or network infrastructure, or conduct DDoS attacks;

• impersonate another person or falsely claim affiliation with the Museum.

4) Intellectual property rights

• Unless otherwise indicated, rights to texts, images, videos, audio materials, design, logos, and other content on the Site belong to the Museum or are used under licence/permission. All rights reserved.

• Some materials may have specific terms of use or a named rights holder — such terms prevail over these Terms.

• Use of trademarks and logos without written permission is prohibited.

5) Educational and non‑commercial use

We support the dissemination of knowledge. With a clear attribution to our Site, quoting short excerpts of text for non‑commercial educational/scientific purposes is allowed under fair‑use‑like principles. For republication of full texts, images, videos, or audio, written permission from the Museum or the rights holder is required. Please contact: vyhodaheritage@gmail.com.

6) User enquiries and feedback

• The Site provides a contact form (name, e‑mail, message) to reach the Museum. The form is not intended for emergencies and does not support file uploads.

• By submitting a message, you confirm you have the right to use its content and that it does not infringe third‑party rights.

• Processing of personal data is described in our [Privacy Policy]; please review it.

7) Third‑party links

The Site may contain links to third‑party websites or services. We do not control their content and are not responsible for their materials or policies. You follow such links at your own discretion and risk.

8) Disclaimer of warranties

The Site and its materials are provided without any express or implied warranties, including warranties of fitness for a particular purpose, accuracy, or timeliness. While we endeavour to ensure accuracy, errors or inaccuracies may occur; schedules, events, and exhibitions may change.

9) Limitation of liability

To the extent permitted by law, the Museum and its staff shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Site, even if advised of the possibility of such damages.

10) Indemnification

You agree to indemnify and hold harmless the Museum, its employees, and partners from claims, demands, costs, and losses arising from your breach of these Terms or of applicable law.

11) Changes to the Terms

We may revise these Terms from time to time. The updated version will be posted on this page with the date of the latest update and becomes effective upon publication unless stated otherwise.

12) Governing law

These Terms are governed by the laws of Ukraine. Matters not covered herein shall be resolved in accordance with applicable Ukrainian law.
